Main changes in anti-corruption legislation

The Law of July 15, 2015 "On Combating Corruption" is a holistic document determining corruption prevention mechanisms, including restrictions established for officials and equitable persons, regulates the procedure for declaring the income and property of such persons, enshrines systemic measures to combat corruption.

The provisions of the law are aimed at consistently improving the anti-corruption legislation of Belarus, in particular, the adoption of additional measures to reduce the motivation of officials to corruption behavior, an increase in the realization of the inevitability of punishment for corruption crimes, as well as the maximum strengthening of the role of the public in identifying the facts of corruption and informing law enforcement agencies.

In addition to the current anti-corruption mechanisms, the law establishes a ban on the appointment for senior positions dismissed by discrediting circumstances (before the expiration of five years after such a dismissal), as well as a ban on receiving the public service for those who have previously committed a heavy or particularly severeThe crime against the interests of the service is either associated with the use of their official authority (indefinitely).

The deprivation of government officials who committed these crimes, retirement rights for serving years in accordance with the legislation on the public service and the provision of only age pensions.

In addition, the procedure for declaring the income and property of certain categories of state officials in order to maximize their real property provisions.

The removal mechanism is introduced from the state official who occupies a responsible provision, as well as entered the public service by election, property, the cost of which is 25% and more exceeds the income received by this official for the reporting period from legal sources.

Changes are made to the Criminal Code of the Republic of Belarus, the Code of the Republic of Belarus on administrative offenses and some other legislative acts, taking into account the practice of applying legislation in the field of combating corruption, as well as in connection with the need for coordination with the norms of the law "On the fight against corruption".

The law not only enshrines additional measures to combat corruption, but also implement individual initiatives of citizens who have received during public discussion of the draft law aimed at reasonable liberalization of relations in this field.

In particular, the Institute of Public Control in the Anti-Corruption Institute is introduced, the forms of participation of citizens are enshrined in such activities (including participation in the development of projects of regulatory legal acts in the field of combating corruption and in the work of the Corruption Commissions).

A ban on external part-time work is canceled for legally significant actions that do not entail significant consequences (chiefs of units, services, departments, workshops, laboratories at various enterprises). The law provides for the dissemination of this ban solely on officials with real state-powerful powers (civil servants, military personnel, managers and chief accountants of state organizations and non-state organizations with state ownership shares of at least 50%).

To prevent a formal approach to the application of recovery measures, liability is eliminated for insignificant inaccuracies in declaration of income and property.
